City Looking at Moratorium, Zoning Restrictions to Replace Pot Shop Ban

The Attorney General's office says that while an outright ban on medical marijuana undermines the new law, placing a temporary ban until state regulations are decided or simply placing zoning restrictions on facilities are legal alternatives.

 

Mayor Ted Bettencourt, faced with the possibility of the city's new ban on medical marijuana dispensaries being struck down, says he's considering a moratorium instead until state health officials put regulations in place this spring.

Attorney General Martha Coakley released a decision last week that found Wakefield's ban on medical marijuana in conflict with the state law approved by voters in November. Peabody's ban is very similar to Wakefield's.

Coakley said cities and towns cannot enact outright bans, but rather limit such facilities to certain areas through zoning or impose a moratorium until regulations are in place.

Bettencourt tells the Salem News the city's lawyers are reviewing the matter and the City Council may also revisit a zoning amendment to restrict where treatment centers could operate in the city.

Bonnie...Could you explain to me why that would be a deterrent please?
Keeping in mind that it IS and would be a legal and legitimate business where customers are licensed/permitted by the Commonwealth to purchase and use marijuana legally. I think people are having a hard time letting go of the days when it was flat out illegal.... You do realize that it was not even a crime to possess UP TO one ounce of marijuana prior to this law passing.. Granted it could be confiscated and a very light fine levied but that is the extent of the law on that...
As for saying to place it next to the police the police station..That actually would be a desirable place as it would be protection against possible robberies.
Times have changed folks time to move on and focus on ACTUAL problems.

Peabody politicians are showing that they do not care about the will of the PEOPLE. They are simply being obstructionists. The citizens of the Commonwealth of Massachusetts have voted and made it abundantly clear (63.3% vs 36.7%) that this is what they want. Now maybe those politicians in Peabody should be thinking of who they are alienating with these backdoor ways to circumvent the will of its own constituency. I know that if I personally voted for the legalization of medical marijuana and I noticed the same people that I voted for city offices obstructing the process I would rethink for whom I will be voting for in the next election. They need to keep in mind the a greater percentage voted for the passage of the medical marijuana bill to pass....so think before you act Peabody. You might find that those same voters will bounce your paranoid asses out of office if you continue wasting taxpayers money on lawyers trying to figure out ways to backdoor this simple straight forward law that passed with a clear majority vote by the citizens of the Commonwealth of Massachusetts.
This is just another case of the minority ( in office politicians) running roughshod over the RIGHTS AND WILL of the less influential people.
Remember that 63.3% of the people voted YES.
Are the politicians framing themselves as protecting the citizens of Peabody? If so they are actually doing quite the opposite.
WE DON'T NEED TO BE PROTECTED FROM OUR OWN WILL

Gamache has the right idea......go with it and own it.
It is the law.
Mayor Bettencourt and the counselors trying to put up barriers and roadblocks to thwart this new law are simply wasting the taxpayers dollars and spending time that could very well be spent working on real problems. Instead of spending their time trying to figure out ways to stop legitimate tax paying businesses to operate legally in Peabody (at the taxpayers expense).
